What Should You Do If Your Insurance Company Refuses To Pay Out?

Car insurance is there to help you cover the cost of any damage that is sustained during a car accident. Most of the time, the insurance company will pay out without too much fuss and you can get your car back on the road again in no time. But there are some cases where they will refuse to pay, and it leaves you in a tough situation if you don’t have the money to pay for the repairs yourself. When this happens, a lot of people just give up and assume that they’ll never win against the insurance company, but that isn’t true. If you really think that the insurance company should pay out and they refuse to do so, here’s what you should do.

Ask For An Explanation

The first thing that you need to do is ask for an explanation from the insurance company so you can find out exactly why they are refusing to pay your claim. It’s important that you spend some time learning the ins and outs of car insurance so you fully understand the policy and they can’t confuse you by throwing a lot of technical terms at you. A lot of car insurance companies rely on the fact that customers don’t fully understand the policy and they will word policies in such a way that it helps them to claim that they are not liable to pay. But as long as you understand the policy, you can challenge them on this. If they still do not want to pay, you need to take things a step further. 

Seek Legal Advice 

The next step is to find a lawyer to help you make a case against the car insurance company. Look for a specific car accident lawyer that has experience in cases against insurance companies. They will help you to gather all of the documentation that you need to argue your case, and they can contact the insurance company directly, offering them a payment deadline before things move any further. Often, a letter from your lawyer is enough to get the insurance company to back down and pay the claim. However, this is not always the case so be prepared to fight them in court if necessary. 

Small Claims Court 

If the amount owed is not very large, there is a chance that you will be able to settle the matter in small claims court. This is a much simpler, and cheaper process than filing a lawsuit against them, and if you can prove that your policy covers you in this situation, you should get your money. 

File A Lawsuit

If the matter cannot be settled in small claims court or the amount of money owed is too large, you may be left with no other option but you file a lawsuit against the insurance company and force them to pay the money that they owe. 

If you want to get your money and the insurance company are being difficult, you need to be prepared for a fight. But if you are willing to take it all the way, you can get them to pay.
